Know Your Right While Switching Jobs in Qatar and How You Can Come Back If You Are Under Ban

Expatriate comes from all across the world for employment opportunities in Qatar, this rich country

attracts talent but at the same time it have a few rules that needs to be adhered to

Qatar’s new sponsorship law was implemented on 13th December 2016, it removed the two-year ban on the foreign workers and empowered them to search for new opportunities in the market according to their choice.

Individuals who feel like they are struck in their job however, not certain and confident to truly realize what exactly they can do or from where to begin can now go through the below points and make a decision.

If fixed term mentioned in the CLOSE END CONTRACT is over

Expats who have finished their fixed term contracts do not require approval from their employer for job change.

If Fixed Term in the CLOSE END CONTRACT is not over

Free switch of jobs isn’t available to workers for whom the contract period is not over, they require consent from existing employer, in case the employer is not providing NOC, expat needs to remain out of Qatar till the contract lapses. Once the contract term is over expat can return to Qatar and can work for other organization with the consent of MADLSA.

In any case, if the expat can demonstrate he was ill treated by the employer, law empowers them with the right to request change of job.

5-Years service completed in OPEN END CONTRACT 

These Expats do not require NOC from their employer for job change, just consent from MADLSA is required. However, the notice period should be served after informing the employers.

5-Years service not completed in OPEN END CONTRACT 

These Expats can not promptly change the job, consent from current employer is required, in the event that the employer is not ready to give NOC, expat needs to remain out of Qatar till the 5-year contract terminates, later after lapse of the contract term, expats can come back to Qatar and can join another employer with the consent from MADLSA.

Expats who are intending to change their job have different choices as below 

1. ) Expats do not need exit permits to leave Qatar, as law no. 21 is replaced with a modernized contract based framework. However, workers need to notify the authorities 3 days in advance.

2.) Decision to change employment will rely upon 2 factors – a.) if the contract is open end or it is close end ,b.) service period time.

3.) Service period to be calculated from the day employee started to work.

If you are presently facing ban in Qatar 

If you have worked in Qatar before however, now you are under ban than you can return back to Qatar without NOC, in case you holds an offer from a new employer.

Avoiding the 4 year ban if the employee was fired or terminated

As indicated by Article 26 of the new law, if a foreign employee is terminated as a corrective measure and he didn’t appeal his expulsion or his plea was dismissed by a court, he is not allowed to return to Qatar before four years.

  • If employee was terminated or fired as a result of a punishment, employee will be BANNED for FOUR Years.
  • If the reason of termination is not right or it is unacceptable expulsion, employee can appeal in the Court.
  • If Court dismissed the plea or in the event that employee failed in the appeal, employee still face the four years Ban.
